Lasting Power

A Lasting Power of Attorney is a legal tool that enables a person you trust, such as a family member, to make important decisions about your health and welfare and / or your financial affairs on your behalf, should you be unable to make these decisions due to the loss of mental capacity.

Following the introduction of the Lasting Powers of Attorney and Capacity Act in 2018, it is now possible to create a Lasting Power of Attorney in Gibraltar.

It is vital that you set up a Lasting Power of Attorney sooner rather than later, and while you are still mentally capable of doing so. If you are injured or develop an illness that may leave you mentally incapacitated and you do not have a Lasting Power of Attorney in place, you run the risk of forcing your loved ones into potentially lengthy, distressing and expensive court proceedings in order to deal with your financial affairs and/or decisions involving your care.

At TSN we can provide with simple, straightforward and practical legal advice that will enable you to decide whether or not you should be making a Lasting Power of Attorney. If you are thinking about making a Lasting Power of Attorney, and don’t yet have, or wish to update your existing will, we’d be happy to assist you with both.
